Re: Services Update: Expedited Processing & Court Dates in Durham & Cumberland Counties
Dear Valued Client:
As many of you know, we at The Eviction Team have always considered ourselves to be your Eviction Services Partner, and are always seeking new ways to provide you with more and better services. One of those ways is through our active involvement with State legislators and local Officials. We also work hand-in-hand with lobbyists in the state capital who are fighting behind the scenes on behalf of our Multifamily clients, going to bat for you and your Owners. Over the last year, one of our strongest efforts has been working with various County Clerks of Court and the Sheriff’s Departments in order to identify ways to shorten the number of days it takes to have our eviction hearings scheduled for you. We are pleased to say that these efforts have paid off with some exciting news.
Beginning this month, Durham and Cumberland County Clerks have committed to giving us the opportunity to schedule court dates for your eviction cases as quickly as 7 business days after the date they receive them for filing. This may provide as much as a 2-3 day reduction from the current scheduling we have been dealing with to date. We have already begun working on adding processes and staff, which will enable us to take advantage of this opportunity for you. Our goal is to do everything we can to provide the expedited processing for your cases that will be needed to capitalize on this exciting development including the use of Early Morning delivery with our Overnight Courier provider.
What this means for you is that, for new evictions that are submitted to us by 9am with all required documents and information, we will expect to have those cases in the Court’s hands and filed no later than the next business morning. When that happens, we hope to begin seeing your court dates scheduled by the Clerk as quickly as only ONE WEEK LATER! We know you will be as excited as we are to see the savings in time and lost rental income this will create for your Properties.
In order to accomplish all of this, though, we will need to increase our pricing slightly. Beginning on November 10th, our rates for evictions filed in Durham & Cumberland Counties will go up by $10 per case. The new breakdown for each eviction will be as follows — you’ll add up each fee below that applies to get your per eviction total:
- Clerk of Court Filing Fee – $96
- Sheriff Service Fee – $30 per defendant
- Attorney Fee – $75
- Subsidized/Mobile Homes – $45
For most of you, this means you will be paying $201 for simple non-payment eviction of one tenant instead of the previous $191. If you have subsidized tenants or you are a mobile home community, you would need to add on the standard $45 upcharge that you are already familiar with.
I trust you will agree that this minimal investment will add much, much more to your Property’s bottom line as you start getting your eviction Judgments this much sooner, enabling you to either recoup your unpaid balances or regain possession and turn those units into new (and hopefully) better-paying residents faster, as well.
